There is no need to embark on a lengthy analysis of the evidence. From a consideration of such evidence as was given before the Magistrate and his reasons and the notice of reasons for appeal, we are satisfied in all the circumstances that the proper order of the court should be that the appeal is allowed and the case remitted to the Second District Court to be heard ‘de nova’ before a differently constituted Court. No order as to costs.
